These Terms & Conditions (“Terms”) apply to all purchases of products made by consumers via the Nude Nova website www.nudenova.co.uk (“Website”) and to your use of the Website.
They are designed to comply with UK consumer law, including the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. Nothing in these Terms affects your statutory rights.
By placing an order with us, you agree to be bound by these Terms.

2. Scope of These Terms
These Terms apply where you are purchasing as a consumer (an individual acting for purposes wholly or mainly outside your trade, business or profession).
If you are buying for a business, please contact us to discuss separate terms.
We currently only deliver within the United Kingdom.
3. Placing an Order

Product listings on our Website are an invitation to treat (not an offer to sell), not a binding offer.

You place an order by:

Adding products to your cart

Completing the checkout process and confirming payment

You will receive an order confirmation email when we have received your order. This confirms we’ve received your order, not that it has been accepted.

A binding contract is formed only when we send you a dispatch confirmation email or when we dispatch the goods, whichever happens first.
We may decline an order, for example if a product is unavailable, if there is an error in the price or description, or if we suspect fraudulent activity. If payment has already been taken, we will refund you in full.
4. Products & Descriptions
We aim to ensure that all product descriptions, images and information are accurate and up to date. However:

Colours and packaging may appear differently on different screens

From time to time, the brand or batch supplied may differ from product images, but will always be of the same type, quality and equivalent specification
If a product does not match its description or is faulty, you may be entitled to a repair, replacement or refund under the Consumer Rights Act 2015.
5. Prices, Payment & Taxes

All prices on the Website are in Pounds Sterling (GBP) and include UK VAT where applicable, unless stated otherwise.

Delivery charges are shown separately at checkout.

We may change prices from time to time, but this will not affect orders we have already accepted.

Payment is taken using the methods shown at checkout. Your payment provider may apply their own charges.
If we discover a genuine error in the price of a product you have ordered, we will contact you. You may then choose to reconfirm your order at the correct price or cancel it for a full refund.
6. Delivery

We currently deliver to UK addresses only.

Unless we agree otherwise, we will deliver the goods within 30 days of accepting your order, as required by UK law.
Risk in the goods passes to you when they are delivered to the address you gave us. Ownership passes once we have received full payment.
Please check your order on arrival and notify us promptly if anything is missing, damaged or incorrect.
7. Your Right to Cancel (Online / Distance Purchases)
If you are a consumer buying online, you have a legal right to cancel most contracts entered into at a distance under the Consumer Contracts Regulations 2013.
7.1 Cooling-Off Period (Change of Mind)

You have 14 calendar days from the day after you receive your goods to tell us that you wish to cancel your order.

Once you have notified us, you then have another 14 days to return the goods to us.

This gives you up to 28 days from delivery to return your items, provided you follow the legal timeframes.
To exercise your right to cancel, you must clearly inform us (for example, by email) that you wish to cancel. You can use our Returns & Refunds form or any clear statement.
7.2 Exceptions – Hygiene-Sensitive & Sealed Goods
Your legal right to cancel does not apply to certain types of goods, including:

Sealed items not suitable for return for health protection or hygiene reasons, once unsealed, such as:

Skincare, haircare, bodycare products

Makeup and cosmetics
-
Fragrances and deodorants
-
Personal care items (e.g. toothbrush heads, beauty tools with skin contact)

Food supplements, vitamins and ingestible wellness products

For these items, you may only return them if they are unopened, unused and in their original sealed packaging, or if they are faulty. This exception is permitted by the Consumer Contracts Regulations.
7.3 Effects of Cancellation
If you cancel your order under your statutory cooling-off rights, we will:

Refund the price of the goods

Refund the standard delivery charge you paid for your order (if you cancel the entire order)

Make the refund within 14 days of receiving the goods back or receiving proof that you have sent them back, whichever is earlier
We may make a deduction from the refund if the goods have been handled beyond what is necessary to establish their nature, characteristics and functioning (for example, if the packaging is damaged or the product appears used).
You are responsible for the cost of returning the goods to us, unless the goods are faulty, damaged or not as described.

If an item is faulty, damaged or incorrect, please contact us on 'sales@nudenova.co.uk' as soon as possible (ideally within 48 hours of delivery) with your order number and photos/videos of the issue.
Where a product is confirmed to be faulty or incorrectly supplied, we will:

Offer a replacement (if available) or a refund, and

Cover reasonable return postage costs
Your statutory rights are not affected.
9. Use of the Website
You agree that you will:

Use the Website only for lawful purposes

Not misuse the Website (e.g. attempting to hack, introduce malicious code, or interfere with its operation)

Not attempt to gain unauthorised access to our systems or user data
We may suspend or restrict access to the Website for maintenance, security or operational reasons.
10. Our Liability
Nothing in these Terms excludes or limits our liability for:

We are not responsible for any loss or damage that was not foreseeable when the contract was formed. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the contract.

We are not liable for any business losses and we only supply the products for domestic and private use. If you use the products for any commercial, business or resale purpose, we will have no liability to you for any loss of profit, loss of revenue, loss of contracts, loss of data, loss of goodwill or loss of opportunity.
Limitation of Liability
To the extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with each order of products (whether in contract, tort, negligence or otherwise) is limited to the total price you paid for the products under that order.
11. Dispute Resolution
If you have a complaint or dispute with us, please contact us in the first instance using the contact details provided on our website. We will do our best to resolve your concerns promptly and fairly.
If we are unable to resolve a dispute informally, you may be entitled to refer the matter to an alternative dispute resolution (ADR) provider or to bring a claim before the courts of England and Wales. This does not affect your statutory rights as a consumer in the United Kingdom.
13. Events Beyond Our Control
We are not responsible for any failure to perform, or delay in performing, any of our obligations where this is caused by an event outside our reasonable control (for example, strikes, natural disasters, pandemics, transport disruptions, or failures of telecommunications or utilities).
If such an event occurs, we will take reasonable steps to reduce its impact and keep you informed.

16. Governing Law & Jurisdiction
These Terms, and any disputes or claims arising out of or in connection with them (including non-contractual disputes), are governed by English law.
You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. This means you may also bring a claim in your local courts elsewhere in the UK if you live in Scotland or Northern Ireland.
